Student Terms of Service

Real conversation. Real careers. We, not me. — These Terms are written plain-English first. The lawyer-grade language follows so both Randy and you know exactly what you agreed to.
1. Acceptance of these Terms
By creating an account, subscribing, or attending a class on the I Speak Everything platform (“ISE,” “we,” “our,” or “the Company”), you (“you” or “the Student”) agree to these Student Terms of Service (the “Terms”). If you do not agree, do not use the service.
These Terms form a binding contract between you and Randy Plaice doing business as I Speak Everything, with a principal office in the State of California, United States. If we later operate the service through a U.S. entity, that entity will be substituted as the contracting party without further notice.
You must be at least 13 years old to use ISE. If you are between 13 and 17, a parent or legal guardian must accept these Terms on your behalf, and that adult is the contracting party for billing, recording consent, and all other purposes.
2. What ISE is
ISE is a bilingual language-learning service that pairs you with vetted human teachers (“Profesores/Profesoras”) and a learning app. From Day 1, ISE offers instruction in Spanish and in English; additional languages will be added as market demand supports them. The service includes:
- One-on-one live classes with a Profesor/Profesora over video, in Spanish or in English.
- Optional group classes and community events.
- The ISE learning app for self-study, practice, and review between classes.
- Community spaces (chat, forums, events) for connecting with other students and Profesores/Profesoras.
The exact mix of features available to you depends on the plan you purchase. We may add, change, or retire features over time, but we will not materially reduce paid features mid-billing-cycle without offering you a refund or a comparable substitute.
3. Pricing and subscription mechanics
3.1 Plans and billing
ISE is sold primarily as a recurring subscription. Plan prices, included class hours, and renewal cadence are shown at checkout and in your account. You authorize us to charge your payment method on each renewal until you cancel. We will notify you at least 14 days before any price increase takes effect on your plan.
Our current published plans:
- Standard — $149/month (or $1,490/year, ~$124/month equivalent), 4 hours of one-on-one class time per month plus unlimited group classes (subject to a minimum-three-students-per-group rule).
- Premium — $269/month (or $2,690/year, ~$224/month equivalent), 8 hours of one-on-one class time per month plus unlimited group classes plus priority scheduling and personalized curriculum.
- Immersion — $449/month (or $4,990/year, ~$416/month equivalent), 16 hours of one-on-one class time per month plus unlimited group classes plus a dedicated Profesor/Profesora matched to your goals, monthly progress review call, and certificate of completion per level.
Plans renew on the 1st of every month so the cycle is the same for every student. Annual plans renew on the anniversary of your initial annual charge.
3.2 What you pay at signup — today vs. going forward
Because every plan resets on the 1st, your very first charge covers two billing periods at once: the remainder of the current month plus your first full month. After that, you are on the normal monthly cadence.
Your checkout screen will show this explicitly. The plain-English version looks like this:
Today’s charge: $X — covers the rest of this month plus your first full month.
This first charge is larger than usual because it covers two billing periods at once. Every month after this will be just $149 — less than today.
Starting [Date]: $149 every month, automatically, on the 1st.
You’ll get [Y prorated hours] for the remainder of this month, then a fresh allotment of one-on-one hours every month going forward — same day every time so you always know when it resets.
How the math works
Your first charge is calculated as follows:
- Prorated portion = (days left in the current month ÷ days in the current month) × monthly price.
- Next-month portion = the full monthly price for your plan.
- Total today = prorated portion + next-month portion.
Your prorated class hours are calculated the same way: (days left in the current month ÷ days in the current month) × the plan’s monthly hour allotment, rounded to the nearest 30 minutes.
Worked example. You sign up for Standard ($149/month, 4 one-on-one hours) on the 17th of a 30-day month. Days remaining in the month: 14. Prorated portion: 14/30 × $149 = $69.53. Next-month portion: $149. Total today: $218.53. Prorated one-on-one hours for the rest of this month: 14/30 × 4 = 1.87 hours, rounded to 2 hours. Group classes are unlimited and not prorated. Starting on the 1st of the following month, you are charged $149 and receive a fresh 4 hours.
After this first charge, every monthly charge is exactly the published plan price for the plan you are on — no more proration, no surprises.
3.3 Use-or-lose hours
Subscription class hours are use-or-lose. Hours included in a billing period that are not used during that period do not roll over and have no cash value. We are revisiting this policy and may improve it; we will not retroactively take away rollover you already had under a published prior policy.
3.4 Vacation hold
You may pause your subscription for up to 30 days per calendar year, in increments of at least 7 days. While paused, you are not billed and you do not accrue class hours. Submit the hold from your account at least 24 hours before your next billing date.
3.5 Switching Profesores/Profesoras
You may switch among any of the Profesores/Profesoras on your matched shortlist at any time, for any reason. Use the in-app switch tool; no explanation is required. Your hours and plan stay the same. If you want a wider shortlist, ask in-app and we will refresh it.
4. Booking, cancellation, and no-shows
4.1 Booking window
Classes may be booked up to 2 weeks (14 days) in advance. We cap the window so Profesores/Profesoras can plan their lives and so we can rebalance schedules fairly.
4.2 Cancellation
You may cancel a booked class for free up to 24 hours before its scheduled start time. Cancellations made inside the 24-hour window mean you lose that class hour from your plan.
4.3 Student no-shows
If you do not join a booked class, you lose the class hour. There is no strike system. The Profesor/Profesora is paid in full for the time they reserved for you.
4.4 Profesor/Profesora no-shows
If a Profesor/Profesora does not show up to a class you booked, you get (a) a free replacement class with a Profesor/Profesora of your choice and (b) a 30-minute class credit on top, as our apology for your time.
4.5 Bad-class recourse
If a class falls clearly below standard — the Profesor/Profesora was unprepared, unprofessional, or the technology failed on our side — report it from the class summary screen within 7 days. We will (a) give you a free replacement class and (b) place a flag on the Profesor/Profesora’s record. The flag is reviewed by the country lead and clears after that conversation. Flags affect a Profesor/Profesora’s standing internally; they do not entitle you to any disclosure about her record.
5. Class recording and use of recordings
Important. ISE records every class. By accepting these Terms you give your consent to that recording. This is not buried. Read this section.
All ISE classes are recorded by ISE. Recordings include video, audio, and any text exchanged during the session. We record so that we can (a) help you review your own progress, (b) train our Profesores/Profesoras and improve the service, (c) resolve disputes, and (d) protect the safety of students and Profesores/Profesoras.
5.1 Your consent
By accepting these Terms, you grant ISE permission to record every class in which you participate, and to store and use those recordings as described in this Section 5. This consent is global — it applies to all classes, all Profesores/Profesoras, and any future ISE features that depend on class recording. You do not need to consent separately for each class.
5.2 Retention
We retain class recordings for 90 days by default and then delete them. Recordings tied to a flagged class, an active dispute, an appeal, or a safety report are retained until the matter is fully resolved and any applicable legal hold has expired.
5.3 Your access
You may request a copy of any class recording in which you are the only student, within the 90-day window, through your account. Group class recordings are not provided to individual students.
5.4 Use beyond your class
We will not publish a recording externally (e.g., on social media, in marketing) without the additional, specific written consent of every identifiable person in it.
5.5 Withdrawing consent
Because the service depends on universal recording, you cannot opt out of recording while remaining an active subscriber. You may cancel your subscription at any time (Section 7) and request deletion of your recordings under Section 9.
6. Profesores/Profesoras, conduct, and the team you’re joining
6.1 Your Profesor/Profesora
After onboarding, we offer you a shortlist of Profesores/Profesoras matched to your goals, level, and preferences. You pick. You can switch any time (Section 3.5).
6.2 Your conduct toward Profesores/Profesoras
Profesores/Profesoras are professionals and members of our team. Treat them that way.
A Profesor/Profesora may end a class immediately and report you if you (a) harass, threaten, or use slurs against her or any other person; (b) appear visibly intoxicated to a degree that prevents the class from proceeding; (c) make sexual advances or expose yourself; (d) attempt to coerce her into contact outside the ISE platform; or (e) record the class yourself without disclosing it. The country lead reviews any such report.
First incident results in a written warning to your account. Second incident results in immediate termination of your account, with no refund of unused subscription hours. The Profesor/Profesora is paid in full for any class she had to cut short.
6.3 No contact outside the platform
You will not receive a Profesor/Profesora’s email, phone number, social-media handles, or any other off-platform contact information through ISE. All communication with your Profesor/Profesora is routed through ISE’s in-app messaging interface, which keeps both of you safe and supported. Do not ask a Profesor/Profesora to contact you off-platform; doing so is a violation of these Terms and grounds for the conduct action in Section 6.2.
7. Cancelling your subscription and refunds
7.1 How to cancel
Cancel any time from your account. There is no cancellation fee.
7.2 Refund model
ISE is a blended product (live service plus content). If you cancel mid-billing-cycle:
- Class hours used or reserved in that cycle are non-refundable.
- Unused class hours that have not been reserved are refunded on a pro-rata basis. The pro-rata refund equals (unreserved unused hours ÷ total hours in the cycle) × (cycle price), less any promotional discounts that would not have applied at the smaller plan size.
- App and content access ends on the date your cancellation takes effect (the end of the current cycle, unless you request immediate cutoff).
If you booked the plan within the last 7 days and have not yet taken a class, you may request a full refund — no pro-rata math, no questions. This is our cooling-off window. The 7-day cooling-off window applies to your full first charge (including the prorated portion and the next-month portion described in Section 3.2).
7.3 Disputes about a charge
If you think we billed you incorrectly, contact us before disputing with your card issuer. We aim to resolve billing questions within 5 business days. Chargebacks initiated without first contacting us may result in account suspension.
8. Privacy and your data
We collect only what we need to run the service: your account info, payment details (processed by our payment provider; we don’t store full card numbers), your class schedule, your in-app progress, your messages with Profesores/Profesoras and support, and your class recordings (Section 5).
We do not sell your personal information. We do not share your contact information with Profesores/Profesoras — your Profesor/Profesora sees the name you choose to display, your time zone, and your learning profile, and nothing else.
Service providers we use (cloud hosting, payment processing, video infrastructure, analytics) receive only the data they need to do their job and are bound by contract to protect it.
You may request access to, correction of, or deletion of your personal information at any time by writing to privacy@ispeakeverything.com. We respond within 30 days. Deleting your account deletes your personal data and your class recordings within 60 days, except where we are required to retain certain records for legal or accounting reasons.
9. Communicating with us
9.1 Support and account questions
Day-to-day support runs through the in-app help screen and support@ispeakeverything.com. Account, billing, and privacy questions all reach us there.
9.2 Public suggestion box
ISE runs a public suggestion box at /feedback. Any visitor — student, family member, prospective student, member of the public — can submit feedback, complaints, ideas, or concerns through that form. You do not need an account to use it.
How a submission is handled:
- Routed to the country lead for the territory you identify (or the closest match if you don’t pick one); a copy is cc’d to Randy.
- Acknowledged within 7 days. The acknowledgment names the country lead handling it and gives a working timeline.
- Discussed publicly at the weekly profesor/profesora team meeting under “Family feedback,” and the resulting decision (do it, defer it, decline it, more info needed) is reported back to the submitter.
The suggestion box is not the channel for safety reports or for legal notices — those should go to support@ispeakeverything.com and legal@ispeakeverything.com respectively, as described in Section 14.
10. Resolving disputes
If something goes wrong, we want to fix it without lawyers. Our dispute process has three tiers:
Tier 1: Direct conversation
You and your Profesor/Profesora try to talk it out, with the in-app country lead available to mediate.
Tier 2: Country lead decision
If Tier 1 does not resolve the issue, the country lead for your Profesor/Profesora’s region reviews the recording, the messages, and any statements from both sides, and issues a decision. The country lead acts independently from the founder for this purpose.
Tier 3: Country lead final
If Tier 2 does not resolve the issue, the country lead has final authority on the matter within the ISE service. The founder does not override country-lead decisions on student-Profesor/Profesora disputes; this is intentional and structural.
Nothing in this Section 10 prevents you from pursuing any rights you have under applicable consumer-protection law that cannot be waived by contract.
10.1 Arbitration backstop
Any dispute that cannot be resolved through the tier process, and that involves a claim for more than US$2,500, shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Los Angeles, California, by a single arbitrator, in the English language. Claims at or below US$2,500 may be filed in small-claims court.
11. Limitation of liability
ISE provides the service “as is.” To the maximum extent permitted by law, ISE and its founders, employees, contractors, and Profesores/Profesoras are not liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, arising from your use of the service.
Our total aggregate liability to you for any and all claims arising from or relating to the service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, and (b) US$200.
Nothing in this Section limits liability that cannot be limited under applicable law, including for fraud, willful misconduct, or personal injury caused by our gross negligence.
12. Changes to these Terms
We can update these Terms. If we make a material change, we will notify you at least 30 days before it takes effect (via email and in-app notice). Continued use of the service after the change takes effect is your acceptance of the new Terms. If you do not accept the new Terms, you may cancel under Section 7 and we will refund the unused, unreserved portion of your current billing cycle, even if the cooling-off window has passed.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Subject to the dispute-resolution process in Section 10, any judicial proceeding shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

If things go wrong, you talk to her first, then to the country lead, and the country lead has the final say. California law governs.
